Commercial Guarantee

This voluntary commercial guarantee policy outlines the terms and conditions under which Nitro AG situated at Bösch 104, 6331 Hünenberg, Switzerland (“L1”) provides commercial guarantee coverage for:

 

·        L1 Snowboard Jackets

·        L1 Snowboard Pants

·        L1 Snowboard Gloves

 

1.        Application

 

This commercial guarantee policy applies to products either purchased on www.l1premiumouterwear.com or through an authorised dealer.

 

2.        Commercial Guarantee Coverage

 

Nitro guarantees to the original purchaser that new and unused L1 jackets, pants and gloves are free from defects in materials and workmanship, under normal and intended use.

 

This commercial guarantee is only valid for the original purchaser and is not transferable.

 

3.        Commercial Guarantee Period

 

All L1 jackets, pants and gloves manufactured during or after production year 2022/2023 are covered by a commercial guarantee period of two (2) years from the original date of purchase.

 

All products produced prior to 2022/2023 are not covered by a commercial guarantee. This does not affect your statutory rights under applicable consumer protection laws.

 

4.        Submitting and Processing a Claim

Purchased your goods from an authorised dealer? Then please first contact the dealer from where you bought your product and follow their claim procedure. Once your claim is submitted to the dealer the claim will then be processed through our international warranty system. The outcome of your claim and the solution will then be communicated to you through the dealer.

If you don’t receive a solution through your authorised dealer, you can easily reach us at L1 Premium Outerwear via our contact page (INSERT LINK TO L1 CONTACT PAGE). We will then forward your case to our partner in the country where you purchased your product who will then assist you with the claim.

 

Important: You must submit a valid proof of purchase. Without it, your claim may be denied.

 

 

5.        What L1 does in the event of a defect


For inline products, if after inspection by L1 or the authorised dealer, your product is determined to be defective it will either be repaired or replaced at the discretion of L1 or the retailer – depending on the type of defect and product availability.

Repaired or replaced products are only covered for the remaining duration of the original commercial guarantee period.

 

6.        Return shipping costs of claims

 

In the event of a valid commercial guarantee claim or a defect covered by statutory warranty rights, Nitro shall bear the reasonable costs of returning the goods, if they were purchased on www.l1premiumouterwear.com. L1 will provide the customer with a return shipping label from our logistics partner GLS.


Should the customer choose another shipping service provider without L1’s prior consent, L1 shall only reimburse the costs up to the amount that would have been incurred using GLS.

 

Products purchased from an authorised dealer and distributor are subject to the dealers and distributors shipping terms.    

 

7.        Exclusions from Coverage

 

The commercial guarantee does not cover damages caused by:

 

  • Misuse, abuse, neglect, or accidents
  • Normal wear and tear from riding
  • Use of solvents or cleaning agents not specifically for outerwear
  • Impact, abrasion or cuts with non-snow surfaces (snowboard or ski edges, bindings, rocks, rails, stairs etc.)
  • Any reason other than a defect in materials or workmanship

 

8.         Commercial Guarantee Conditions

 

The commercial guarantee is void if there are any modifications or alterations of the original product.

 

9.         Limitation of Liability


This guarantee does not cover any incidental or consequential cost, losses or damages.

 

This limitation does not affect your statutory rights under applicable consumer protection laws, nor does it apply in cases of damages caused intentionally or by gross negligence.

 

10.   Governing law

 

The Swiss courts at Nitro’s registered office shall have jurisdiction. Swiss law shall apply.

 

11.   Supplement to your statutory rights

 

This commercial guarantee does not affect your statutory right of withdrawal and statutory legal guarantee rights under applicable national laws relating to the sale of consumer goods.  These statutory rights are neither restricted nor replaced by this commercial guarantee.
